The Balance of Intellectual Property, Part 1

I haven't forgotten this blog - I've been working on a new IP paper over the past few months, so haven't had the energy to post anything else IP related.

My paper, which I'm 1/2 done, outlines the problems IP Managers have with getting a business focused IP strategy done within the bureaucracy of the legal world they work in. I have come up with a new model that will hopefully address these issues.

Here's my outline of the first 2 sections. Comments would be appreciated:

The Balance of Intellectual Property Management


1 Introduction

Intellectual property managers all have the same problem: balance. The necessity of management bureaucracy vs. the efficiency of self-direction. Bureaucracy required to extract and codify and prosecute inventions vs. the efficiency of self-direction when inventors submit disclosures of the best ideas, ready for patent filing. The measurement of success of this balance is the on most visible metric to top management– what applied value the patent portfolio brings to the company, and the cost to do so.

In reality it is moot whether the portfolio value is measured against its ability to defend, enforce, or against applied against financial valuation models. At their root they all require the same basic patent process to create the portfolio. But this process is costly - supported from both from a tangible attorney and inventor time and from the intangible uses of management time. It is also inefficient – most filed patents are never used in any business or legal environment. Patents, as pure innovation, typically follow the power law: For every valuable idea that is used, another 20-30 that require the same amount of capital on are useless.

From this we can see two main issues: First, the need to increase valuable IP. Second, the need to increase the internal prosecution’s efficiency which will in turn reduce costs. Creating and employing efficient IP processes seems the obvious solution, but it has not been widely successful to date. Some available models only work for a certain size of firm, thus in addressing these two issues the solution is not scalable as an IP Department grows, or becomes mirrored in another part of an organization. Some models require outsourced and as a result any knowledge base is lost, or patent information is too isolated from the company itself. This results in limited or no measurable and realistic metrics of success to top management. To address these points we need to find balance: Management Bureaucracy vs. Inventor Self-direction. Whether it be a new, growing or mature IP Department, we need to step back and re-evaluate the innovation process to ensure any ideas can be successfully applied and balanced. How will we do this? This whole solution can be balanced using a Transactional IP Infrastructure model.

2 Current Reading

There has been much online discussion, white paper and traditional print articles devoted to the processes and policies needed when building an IP Department. Many are rightly copied from existing management processes, but incorrectly applied by firms in practice.

On the print front Suzanne Harrison, co-author of Edison in the Boardroom, gives many high and low level traits that IP savvy companies such as HP, Rockwell, Dow and Ford, use successfully to manage their IP. Harrison approaches IP from a Value Hierarchy perspective, i.e., from an IP perspective are you a Defensive, Cost Center, Profit Center, Integrated or Visionary based firm. Within each of these levels are best practices that a firm should be doing. Read and understood as a whole these traits are valuable, but it is dangerous when a reader picks and chooses practices to apply to their processes without understanding if their company can even efficiently support them in the long term, or even correctly manage them in the short term.

Bill Mead, president of Basic IP, has several guest blog posts on Rethink IP, one of them entitled “6 Life stages of Inventors”. Mead approaches IP issues by using and managing people to drive and change processes. These include creation of social norms to encourage codifying of inventions; monitoring of key inventions (“the scanners”) to ensure they stay involved in the system. With a process inferred, Mead assumes the underlying IP process is established and the norms are built on this. For example he discusses the norm creation in a patent committee meeting which includes a patent attorney, managing counsel and a patent coordinator. While a patent committee with this group is standard for some larger firms, the suggested group may not be realistic, or more importantly, an efficient use of time for the company. Again, using social norms as a measure of an IP Department’s success is only applicable if the right type of internal IP business process is present.

I am not disputing any of the above sources do not provide valuable information, on the contrary they do. However the content provided is not successfully applicable unless some context is given on how it should be applied. Understanding how the underlying process works gives an IP Manager the ability to take such valuable content and apply it where it will be deployed and embraced in a useful manner. Why? Because every firm is different – whether it be defined by physical size, innovation levels, or industry – simply applying content won’t support the social norms of innovation, or the long term sustainability of an IP Department’s key success factor – efficient creation of IP.

Gary Hamel’s recent Harvard Business Review article entitled Management Innovation, details out several cases where new “management innovation” gave great success. GE, Dupont, Proctor & Gamble, Toyota, Whole Foods – they have all done it. Management Innovation is defined as “a marked departure from traditional management principles, processes and practices or a departure from customary organizational forms that significantly alter the way the work of management is performed.”According to Hamel, a management breakthrough will create long lasting advantages when it meets certain conditions. These elements include finding a big problem, finding new principles and approaches to solving it, deconstructing current management traditions and applying analogies from atypical firms to help redefine what is needed. Laying Hamels’ theory of Management Innovation over our IP Management issue of balance, we can easily see our IP problems of balance line up for a Management Innovation overhaul. Through the Management Innovation process, we can discover the basis for creating a Transactional IP Infrastructure to apply within any IP Department.
